تقرير لـ"مركز باستيت": ملاحظات المرحلة الأولى لانتخابات النواب 2025

لم يعرف خلال العقود الأربعة الماضية تدخل الرئيس المصري في الشأن الانتخابي سوى مرتين. الأولى إيجابية، وفيها استجاب الرئيس الأسبق حسنى مبارك لأحزاب المعارضة الرئيسة (الوفد/ التجمع/ العمل)، للنزول بالعتبة الانتخابية في الانتخابات التي جرت عام 1984 بالقائمة النسبية. والعتبة الانتخابية هي تلك التي يتم من خلالها وضع نسبة كحد أدنى لما يحصل عليه الحزب أو القائمة الانتخابية على مستوى الجمهورية، كي يتم تمثيله في البرلمان، حيث خفض الرئيس مبارك في خطاب شهير له تلك النسبة من ١٠% إلى ٨%. المرة الثانية كانت أيضا للرئيس حسني مبارك، وكان تدخله هنا سلبيا، لكونه يشجع على الفساد. إذ عندما علق على الرشاوى الانتخابية في الانتخابات التي جرت في التسعينات بالنظام الأغلبي عبر الأسلوب الفردي من بعض المرشحين للناخبين قال مخاطبا الناخبين (خذوا فلوسهم ولا تنتخبوهم)، ما أعتبره البعض يومئذ تشجيعا للناس على خداع الناخب للمرشح وقبول الرشوة، حتى لو لم يتم تنفيذ مطلب الأخير.

تدخل الرئيس السيسي الإيجابي في الانتخابات

اليوم وبعد كل هذه السنوات، أبرق الرئيس عبد الفتاح السيسي على الناس عبر صفحته على شبكة التواصل الاجتماعي، كما عبر مرة ثانية في لقاء مباشر مع الناس بعد عدة ساعات من تدخله الأول، للخوض المباشر في الانتخابات. حيث أنتقد الرئيس في المرة الأولى النزاعات الانتخابية، وانتقد بشكل مُبطن الهيئة الوطنية المستقلة للانتخابات، بسبب مثالب إدارتها للعملية الانتخابية، وأوصى بإصلاح الأوضاع حتى لو وصل الأمر إلى إعادة الانتخابات التي مضت في كافة دوائر المرحلة الأولى. أما المرة الثانية التي تدخل فيها الرئيس السيسي في الشأن الانتخابي، فكانت بسبب شراهة المال الانتخابي، والرشاوى الانتخابية، لكنه في هذه المرة لم يقُل خذوا الأموال ولا تنتخبوا الراشي والرائش، بل اعتبر أن المال المأخوذ هو تخريب للوطن، وتخريب للسلطة التشريعية، وأن هذا المال أقل بكثير من النتائج التي ستُسفر عنها الرشى الانتخابية.

وهكذا، حمل الانتقاد الذي ذكره الرئيس نوع من الرفض لأسلوب إدارة الهيئة الوطنية للانتخابات، لكونها اهملت الكثير من المواقف.

أداء الهيئة الوطنية في مرمى التقييم

وواقع الأمر أن الناظر إلى الانتخابات وموقف الهيئة الوطنية المستقلة للانتخابات منها، تُصيبه الدهشة من طريقة أدائها، والذي بحت الأصوات من تقييمه، منذ انتخابات مجلس الشيوخ حتى اليوم دون جدوى، وربما منذ انتخابات الرئاسة عام 2024، عندما لم تستطع أن تبرر بالإحصاءات كما فعلت الهيئة السابقة عام 2018 أو لجنة انتخابات الرئاسة عام 2014 كم عدد المؤهلين للانتخاب، والمصوتين الفعليين، والأصوات الصحيحة، والأصوات الباطلة، والكم الذي حصل عليه كل مرشح رئاسي على مستوى اللجان العامة في ربوع الجمهورية. لقد اكتفت الهيئة في الانتخابات الأخيرة بأنها قالت أن عدد المقترعين في الانتخابات 44 مليون نسمة، وأحصتهم على مستوى المحافظات الـ27 فقط، ما جعل المراقبين يتعجبون من هذا الكم الذي ربما لا يجده المرء في نزول الناس للشارع إلا لو حصل زلزال لا قدر الله. بل والأكثر عجبا ان الهيئة كانت تحذر المرة تلو الأخرى، كل من سينتقد عملها وأدائها، معتبرة ذاتها تقوم بعمل قضائي، رغم أن جل عملها هو عمل إداري صرف، لا علاقة للقضاء به، وإلا لم خول القانون الناس حق الطعن على قراراتها أمام محكمة القضاء الإداري، والطعن على قرارات تلك المحكمة الأخيرة أمام المحكمة الإدارية العليا. 

اهتمام الهيئة بتجميع الأوراق والشئون البيروقراطية

واحد من أبرز المواقف التي يضع المرء فيها علامة استفهام، هي أن الهيئة الوطنية للانتخابات بالغت في الاهتمام بالشؤون البيروقرطية وتجميع الأوراق والمستندات بشكل غير طبيعي. هذا الأمر تم تلمسه في إصرارها على إجراء الانتخابات على نصف مقاعد مجلس النواب بالتزكية ودون أي منافسة، لأنها على أرض الواقع وقفت تمنع الراغبين في المشاركة في إعداد قوائم منافسة، بسبب ورقة تخص تجنيد مرشح ناقصة، أو ورقة كشف طبي، أو غياب مستند سيرة ذاتية، أو مستند يُثبت المؤهل، أو خلافه، وبناء عليه منعت عديد القوائم من المشاركة في الانتخابات في القطاعات/الدوائر الانتخابية المختلفة. كل ذلك اسفر عن تشوية حقيقي لصورة مصر في الخارج لكونه قد حسم أمر نصف مقاعد مجلس النواب دون انتخاب. بطبيعة الحال، الأوراق التي طلبتها الهيئة من المرشحين من الأفراد والقوى السياسية مهمة، لكن ما هو أهم سمعة مصر في إجراء اقتراع محسوم بلا انتخاب. بعبارة أخرى، كان على الهيئة أن تضع سقف زمني لبضعة أيام أخرى لاستيفاء تلك الأوراق، مع سير العمل وكأن تلك القوى ستشارك في الانتخابات بشكل متنافس وطبيعى. 

الهيئة تسجن ذاتها في قصر الدوبارة

سجنت الهيئة ذاتها داخل مقرها الإداري، في 106 ش القصر العيني بقصر الدوبارة. إذ راقبت الهيئة سقف الدعاية الانتخابية عبر الحسابات البنكية، المقدمة لها من المرشحين لهذا الغرض، والتي يُفترض إلا يُنفق المرشح الفرد أو القوى السياسية أيه أموال بغرض الدعاية الانتخابية إلا من خلالها، وهي تعلم علم اليقين انه لا يتم الصرف من تلك الحسابات بغرض الدعاية للمرشحين، بل أن الصرف يتم من مصادر أخرى غير رسمية عديدة، مثل الأموال السائلة التي ينفقها المرشح نظير مؤتمراته الانتخابية، وموائد الطعام والشراب لآلاف الناخبين، وشراء كراتين المواد التموينية التي تُوزع عشية أو يوم الاقتراع، ووضع الإعلانات في وسائل الإعلام وفي الشوارع والميادين، وبعض هذه الصور الفجة يكتب بجوارها أنها تبرع من رجل الأعمال ..أو كذا، وكل ذلك يخرق كل السقوف الموضوعة، لكونه يتجاوزها عشرات المرات الكم المذكور في قرارات الهيئة دون رقيب أو حسيب، حتى أنه لا يعرف طوال عمل الهيئة المنشأة وفقا للقانون 198 لسنة 2017، وقانون مباشرة الحقوق السياسية المنشأ للجنة العليا للانتخابات أنها شطبت مرشحا، أو منعت حزبا من خوض الانتخابات بسبب خرق سقوف الدعاية الانتخابية. 

الهيئة تقف مكتوفة الأيدي أمام الرشاوى الانتخابية

كذلك لاحظت الهيئة الوطنية المستقلة للانتخابات دون أي حراك منها الكم الكبير من المال المدفوع نظير تسكين أحزاب بعينها لرجال أعمال وأصحاب رؤوس أموال على الكوتة العددية غير الرسمية التي حددها أحد الأحزاب التي تدير القائمة الوطنية للانتخابات ولو من حيث الشكل) للأحزاب الـ12 المشاركة في الانتخابات. المُتابع للعملية الانتخابية والمشهد الإجرائي لها، لم يلحظ على الإطلاق تحقيق الهيئة -أو إبلاغ جهات عدلية- في مزاعم مئات الشكاوى في مواقع التواصل الاجتماعي، بل واعتراف بعض الأحزاب بتلقي الأمول بسبب الضائقة المالية، وانها اخذت بالفعل أو على الأقل طلبت أموال نظير تسكين رجال أعمال، وأُناس ليسوا أعضاء في تلك الأحزاب من أصحاب القدرات المالية الكبيرة، كي يتم تسميتهم، ومن ثم يصبحوا أعضاء في البرلمان دون اقتراع، بسبب غياب المنافسة، وتزكية القائمة لمجرد حصولها على 5% من أصوات الناخبين المقيدين في القطاع/ الدائرة الانتخابية. 

الهيئة ترتب أسماء المرشحين بلا شفافية وترى التوريث ولا تُجابهه

إضافة إلى كل ما سبق قامت الهيئة -ودون أي رد فعل لشكاوى المتقدمين للترشيح بأنهم تقدموا للترشح في فجر أول يوم- بوضع أسماء المرشحين في مرتبة تالية في قوائم الترشيح، ووضع أسماء أربعة أحزاب مدللة هى بالترتيب مستقبل وطن، وحماة الوطن، والجبهة الديمقراطية، والشعب الجمهوري، في ناصية ورأس قوائم المرشحين، وهو ذات الترتيب الذي تم تنظيمه في ورقة الاقتراع، حتى يسهل على الناخبين الاختيار من خلال وصايا المرشحين المحظوطين بالتمييز. كل ذلك الأمر، كان يتم مع ترديد دائم من الهيئة أنها تقف على مسافة واحدة بين المرشحين.

مرة أخرى تقف الهيئة دون تحريك ساكنا أمام توريث مقاعد البرلمان، بأن تصمُت على رؤية أسماء القائمة الوطنية الأساسية ونظيرتها الاحتياطية، وقد اشتملت على الأبناء والأخوات وأبناء العموم والأخوال وغيرهم من ذات العوائل والأسر. هذه الصورة بالطبع مستحدثة منذ أن عرفت مصر انتخابات القوائم المطلقة المعيبة دستوريا (حكمت المحكمة الدستورية بعدم دستوريتها 3 مرات منذ أربعة عقود) وإخلاقيا (كونها تزوير فاضح لإرادة الناخبين). ففي قراءة للكاتب لنحو 60 أسما من القوائم الأساسية، وجد أن نحو 20 منها على الأقل مُتواجد له أقارب داخل الأسماء الاحتياطية، حتى أن المرء بدأ يتندر بالمقولة المضحكة المبكية التي تشاهد توريث المقاعد والوظائف والمهن في بر مصر وهي "أن الشخص الوحيد الذي فشل في التوريث في مصر هو الرئيس المصري الأسبق حسنى مبارك".

ترقُب قادم لمشهد ملتبس

مع أولى أيام المرحلة الثانية  وبعد أن  قررت الهيئة الوطنية للانتخابات إلغاء الانتخابات في ١٩ دائرة من دوائر المرحلة الأولى الـ70،  واعتبار البعض أنه لولا تدخل الرئيس عبد الفتاح السيسي الإيجابي آنف الذكر، لأصرت الهيئة الوطنية للانتخابات على مسلكها. بعبارة أخرى، فإن الأيام الجارية هى  فيصل ليس فقط في رؤية مشهد استكمال الانتخابات ، بل وأيضا أحكام المحاكم المنتظرة في 252 طعنا انتخابيا عقب إعلان نتائج الجولة الأولى من المرحلة الأولى. والمنتظرة يوم الأربعاء المقبل الأمل كبير أن تكون الهيئة قد وعت الدرس، صحيح أن هذا الوعي - حال حدوثه- جاء متأخرا، لكن يُأمل أن تجرى باقي الاقتراعات بشكل سوى وجيد وبأقل قدر من شكاوى الناخبين والمرشحين.

 

Bastet Center Report: Observations on the First Round of the 2025 Parliamentary Elections… and the Flaws of the List System

Over the past four decades, the Egyptian president has intervened in electoral affairs only twice. The first was a positive intervention, when former President Hosni Mubarak responded to the main opposition parties (the Wafd, the Tagammu, and the Labour Party) by lowering the electoral threshold in the 1984 elections held under the proportional list system. The electoral threshold is the minimum percentage of votes that a party or electoral list must obtain nationwide in order to be represented in parliament. In a well-known speech, President Mubarak reduced this threshold from 10% to 8%.

The second intervention was also by President Mubarak, and it was negative in that it encouraged corruption. Commenting on electoral bribes paid by some candidates to voters in the 1990s elections held under a majoritarian, single-member system, he addressed voters by saying: “Take their money and don’t vote for them.” Many at the time considered this an implicit encouragement for voters to deceive candidates and accept bribes even if they did not carry out the latter’s wishes.

Positive intervention by President Sisi in the elections

Today, after all these years, President Abdel Fattah El-Sisi addressed the public via his social media page, and again a few hours later in a live meeting with citizens, to intervene directly in electoral affairs. In his first intervention, the President criticized electoral disputes and, in a veiled manner, criticized the National Election Authority (NEA) for shortcomings in its management of the electoral process. He recommended rectifying the situation, even if that meant re-running the elections that had taken place in all constituencies of the first round.

In his second intervention in electoral matters, President Sisi focused on the voracious use of money in elections and on electoral bribes. This time, however, he did not say: “Take the money but don’t vote for the briber and the go-between.” Instead, he stated that the money taken amounts to sabotage of the country and sabotage of the legislative authority, and that such money is insignificant compared to the consequences that electoral bribery will produce.

Thus, the criticism voiced by the President amounted to a rejection of the NEA’s method of managing the process, given that it had ignored many problematic situations.

The performance of the National Election Authority under scrutiny

In fact, anyone observing the elections and the stance of the National Election Authority towards them is struck by the way it has performed. Voices have been hoarse with criticism of its conduct from the Senate elections up to today, to no avail—and arguably since the 2024 presidential elections, when the Authority was unable to justify, with statistics as the previous NEA did in 2018 or the Presidential Election Committee did in 2014, the number of eligible voters, the actual number of voters, the valid and invalid votes, and how many votes each presidential candidate obtained at the level of the general committees across the Republic.

In the last elections, the Authority merely stated that the number of voters who cast ballots was 44 million and provided figures only at the level of the 27 governorates. Observers were astonished at such a figure, which one might not see in the streets even in the event of a major earthquake, God forbid. What was even more surprising was that the Authority repeatedly warned anyone who criticized its work or performance, insisting that it was carrying out a “judicial function,” even though most of its work is purely administrative and has nothing to do with the judiciary. If that were not the case, why would the law empower citizens to appeal its decisions before the Administrative Court, and then to appeal the judgments of that court before the Supreme Administrative Court?

The Authority’s focus on collecting documents and bureaucratic matters

One of the most striking aspects that raises question marks is that the NEA has excessively focused on bureaucratic issues and the collection of documents and paperwork in an abnormal manner. This became evident in its insistence on holding elections for half of the seats in the House of Representatives by acclamation, with no competition at all. In practice, the Authority was blocking those wishing to form competing lists from doing so on the grounds of a missing document—such as an incomplete military service certificate for a candidate, a missing medical examination report, the absence of a CV, or lack of proof of an academic qualification. On this basis, it prevented numerous lists from participating in the elections in different electoral sectors/constituencies.

All of this led to a real distortion of Egypt’s image abroad, since half of the seats of the House of Representatives were effectively settled without an election. Naturally, the documents the Authority requested from individual and party candidates are important, but more important is Egypt’s reputation with respect to holding a ballot whose outcome is predetermined without voting. In other words, the Authority should have set a short additional deadline of a few days to allow completion of the required documents, while proceeding on the basis that those forces would be competing in the elections in a normal manner.

The Authority confines itself inside Qasr El-Dobara

The NEA effectively imprisoned itself inside its headquarters at 106 Qasr El-Aini Street in Qasr El-Dobara. It monitored the ceiling on campaign spending through the bank accounts submitted by candidates for that purpose, based on the assumption that no individual candidate or political force would spend any money on campaigning except through those accounts. Yet the Authority knows full well that spending is not in fact taking place from those accounts.

Instead, expenditures are made from numerous informal sources: cash paid by candidates to finance their campaign rallies, food and drink provided to thousands of voters, the purchase of boxes of foodstuffs distributed on the eve of, or on, polling day, and funding advertising in the media and in streets and squares. In some of these egregious cases, it is even written next to the advertisement that it is a “donation from businessman X” or the like. All of this flagrantly violates the spending ceilings set by the Authority, exceeding them by many times the amounts specified in its decisions, without oversight or accountability.

Indeed, throughout the life of the NEA established under Law No. 198 of 2017, and of the High Electoral Commission established under the Political Rights Law, there is no known case of a candidate being disqualified or a party being barred from contesting elections due to breaching campaign spending limits.

The Authority stands idle in the face of electoral bribes

The National Election Authority also observed—without taking any action—the enormous sums of money paid in return for certain parties allotting places on their lists to businessmen and wealthy individuals as part of an unofficial numerical quota set by the party that, at least in form, leads the “National List” for the elections and for the 12 parties participating in them.

Anyone following the electoral process and its procedural aspects will not have noticed the Authority conducting investigations—or notifying judicial bodies—into the hundreds of complaints on social media, nor into admissions by some parties that they had received funds due to financial hardship and that they had indeed taken, or at least requested, money in return for granting positions on their lists to businessmen and financially powerful individuals who were not party members. These individuals were then named as candidates and became members of parliament without any real vote, because of the absence of competition and the automatic success of the list upon securing 5% of registered voters in the sector/constituency.

The Authority arranges candidates’ names non-transparently and ignores hereditary succession

In addition to all of the above, the Authority, without responding to complaints from individuals who applied for candidacy at dawn on the first day, placed their names in lower positions on the lists and gave top placement to four favored parties—Future of the Nation, Protectors of the Homeland, the National Front, and the Republican People’s Party—at the head of the candidate lists. This was the same order adopted on the ballot paper, making it easier for voters to choose in line with the recommendations of those fortunately privileged by such favoritism. All this took place while the Authority repeatedly proclaimed that it stood at an equal distance from all candidates.

Once again, the Authority remained completely passive in the face of the inheritance of parliamentary seats, turning a blind eye to the fact that the main “National List” and its reserve list included sons, brothers, cousins, nephews, and other relatives from the same families. This phenomenon is entirely new since Egypt adopted the constitutionally flawed “absolute list” system (the Supreme Constitutional Court has ruled it unconstitutional three times over the past four decades) and ethically flawed as well, since it blatantly falsifies the will of the voters.

In a review by this author of about 60 names on the main lists, it was found that at least 20 of them had relatives on the reserve lists. This prompted bitter joking about that tragicomic saying that describes inheritance of seats, positions, and professions in Egypt: “The only person who failed at inheritance in Egypt was former President Hosni Mubarak.”

An upcoming, ambiguous scene to watch

With the start of the second round, and after the National Election Authority decided to annul the elections in 19 constituencies out of the 70 in the first round—and with some believing that, were it not for President Abdel Fattah El-Sisi’s positive intervention mentioned above, the NEA would have insisted on its initial course—the coming days will be decisive, not only for how the completion of the elections will be viewed, but also for the judicial rulings expected in 252 electoral appeals following the announcement of the results of the first round of the first phase, which are due next Wednesday.

There is considerable hope that the Authority will have learned the lesson. Although such awareness—if it materializes—has come late, the hope remains that the remaining balloting will be conducted in a sound and proper manner, with the minimum possible level of complaints from voters and candidates alike.
